Re: Solomona settlement
Non Disclosure Agreement - where not discussing the settlement is legally binding on both parties.
Re: Solomona settlement
If he is the talk of that other game and is expected to get international honours surely the price of him as got to be more than before. (Not sure of all the ins and outs of the laws)

Re: Solomona settlement
Possibly but after week 1 I see enough in our wingers to know they will go well. Scoring 3 tries and could have easily been 5 if Eden held on to the ball at end and if Gale didnt beat him to the bouncing ball.HuddsTigers wrote:I would use it to strengthen our squad for a top 4 push. We wanted 500k but I doubt it will be that. Has to be close.

Re: Solomona settlement
Right just a couple of quieries.
This so called out of court settlement, is this with Steve diamond and sale.
If so does that mean Andy Clarke and Solomona get away scot free.
Clarke is the one imo who Cas should go after.
He was the instigator in all this.
Would love to see Clarke and Solomona in the dock.
I know that won't happen, but I believe they have a lot to answer to.
Makes my blood boil to think they as individuals walk away scot free.

A lot of supposition going on here. Nobody confirmed yet that an out of court settlement is pending, just an opening of the discussions. We still need to proceed with caution.

Looks like Gob Sh**e Diamond might be having a bad week.
He has just been banned for 6 week's and fined £3,000.
Ideal outcome :- Cas's claim paid in full
DS to pay his own legal fee's
Clarke's licence withdrawn but RFL
Diamond sacked

Don't forget that if we do get any cash settlement a fair chunk of it will be given to the Loiners for Zac and he won't come cheap.
Re: Solomona settlement
Bad move for RL in general if we settle this out of court. There would be nothing to stop another RU club doing the same thing. I was hoping we would win the case and set a precedent.
Re: Solomona settlement
We are a small club with limited resources - if this runs to trial, litigation costs would be huge. Let someone else fight that battle.Exiled wrote:Bad move for RL in general if we settle this out of court. There would be nothing to stop another RU club doing the same thing. Re: Solomona settlement
It should be the rl to sort out any cross code issues
Re: Solomona settlement
Like you, I wanted this to go all the way and expose DS, Sale and Clarke for the grubs that they are and also to set a president and stop other grubs, from pulling the same trick.Exiled wrote:Bad move for RL in general if we settle this out of court. However if Sale's legal advice is, that they have not got a leg to stand on, then every club, agent and coach in Rugby will know this and will not try it on again. Ie:- the current contract law clearly covers this situation.
There is a good article in the Guardian where Cas's barrister said that he would be pushing for an extensive settlement or they will pursue the case in court, with a provisional date set for April.
Reading between the lines, I see this as cas being 100% in the right ( legally ) with the only issue being the amount of compensation..
Ps :- we still have to pay for Zac Win or lose.

Re: Solomona settlement
I would point out that in the context of breach of contract, the correspondence between the clubs and the extra evidence accumulated by the club may have been the reason why Sale are looking to settle.
It is by no means a legal precedent in terms of contract law, particularly as it hasn't gone to court. Any future cases will be circumstantial and judged on their own merits.
Let's put it in another scenario. If Solomona had retired from his contract and then pitched up at Sale two months later with no emails being sent to the club and no correspondence, then that is an entirely different matter.

Re: Solomona settlement
Out of court settlement needs to be;
Sale admitting publicly that they are in the wrong
£500,000 compensation PLUS our legal fees paid
After that Cas should go to court to get Solomona to repay the £10,000 he borrowed from the club.

And pigs will fly.
I think We'll get 50-100k, quiet-like so Sale don't look too bad.
