Don't forget that if we do get any cash settlement a fair chunk of it will be given to the Loiners for Zac and he won't come cheap.

Bad move for RL in general if we settle this out of court. There would be nothing to stop another RU club doing the same thing. I was hoping we would win the case and set a precedent.

We are a small club with limited resources - if this runs to trial, litigation costs would be huge. Let someone else fight that battle.

Like you, I wanted this to go all the way and expose DS, Sale and Clarke for the grubs that they are and also to set a president and stop other grubs, from pulling the same trick.

However if Sale's legal advice is, that they have not got a leg to stand on, then every club, agent and coach in Rugby will know this and will not try it on again. Ie:- the current contract law clearly covers this situation.

There is a good article in the Guardian where Cas's barrister said that he would be pushing for an extensive settlement or they will pursue the case in court, with a provisional date set for April.

Reading between the lines, I see this as cas being 100% in the right ( legally ) with the only issue being the amount of compensation..

Ps :- we still have to pay for Zac Win or lose.

I would point out that in the context of breach of contract, the correspondence between the clubs and the extra evidence accumulated by the club may have been the reason why Sale are looking to settle.

It is by no means a legal precedent in terms of contract law, particularly as it hasn't gone to court. Any future cases will be circumstantial and judged on their own merits.

Let's put it in another scenario. If Solomona had retired from his contract and then pitched up at Sale two months later with no emails being sent to the club and no correspondence, then that is an entirely different matter.

Sale admitting publicly that they are in the wrong
£500,000 compensation PLUS our legal fees paid

After that Cas should go to court to get Solomona to repay the £10,000 he borrowed from the club.

Really don't think Cas would settle for that at all and if Sale offered it the court case can still go ahead. Also it won't be hush hush as shareholders will be told about it.

This is my take and I'm no expert on such matters.
Sale admitting publicly they were in the wrong. Isn't an out of court settlement to stop just that happening? "We paid a nominal fee in good faith, but in no way is this admitting guilt" type of thing, a bit of face saving.
Didn't Cas bring the charge against Sale? If there is an out of court settlement then Cas would have to call an end of the proceedings wouldn't they? So I can't see Cas getting court costs paid.
My guess, you'll never get to know the settlement but I'd guess £175-£200K, costs to be shared.

I would imagine the settlement to be close to what we ask and include legal costs that are to the satisfaction of our legal team and that won't come out of our settlement figure.

The case is only adjourned, if no settlement, then we just go to court. It's that simple

We can drop certain parties from the claim and continue. We might agree a settlement with Sale but continue against the other parties. Sale may decide to settle for all parties. Who knows.

When it's over Cas will tell us but it's worth remembering that ds is gone and will get our owed 10k or 20 one way or another. Clarke is a snake and has one less club that will deal with him. I'm sure the rfl will deal with him, it's in their interest to prevent this happening again. Diamond will get his, probably the sack, and then we can send him some nice messages of support.

I don't think we'll find it the amount till the next autobiography is released. It is detrimental to our recruitment to tell clubs how much we can spend.

Also we'll have budgeted for Zak. We have players composing of contract to pay him and signing on fees saved from looking for someone else.

The fee was thought to be £200k. The stalling was Leeds wanted 90k up front for the year. Don't know what it ended up been.

As said, the case is adjourned. I'm guessing Sale have been advised by their legal team that we hold all the cards here.

I'd pursue a settlement with Sale of £250k - The £200k they offered + £50k Compensation (Which they offered after signing)

I'd then pursue Solomona and Clarke separately, Solomona is likely to agree a settlement (Due to his inflated wage been able to cover it - Even if having to pay it over 2/3 years) and then hopefully expose Clarke and get him struck off by the RFL.

I said previous, if someone offered us 250k in December. We should snap their hands off and move on, our hands strengthened since then. I'd be aiming for a minimum of £350k. And put the extra towards recruiting a quality winger for next season, for when Monaghan retires.
